Matawan, New Jersey – According to the lawsuit, the plaintiff, Carlos Quintanilla-Martinez, was caused to fall nearly three stories during a construction project. The lawsuit also claimed that contractors allowed the use of an unsafe job-made box to hoist materials to higher floors. The box dislodged and fell to the ground with Mr. Quintanilla inside.

As a result of the incident, Mr. Quintanilla suffered injuries to his spine. He underwent immediate surgery to repair his fractured spine. He also underwent multiple pain management spinal injections without relief. Mr. Quintanilla suffered from an acute compression fracture of the L1 and L3 vertebral bodies and underwent a thoracolumbar spinal fusion performed by Dr. Michael Lispinuso.

The defendant’s examining doctor, Dr. Hutter, opined that Mr. Quintanilla’s spinal condition had reached maximum medical improvement and that there was a moderate degree of orthopedic permanent impairment in regard to the lumbar spine.

The matter resolved at trial before opening statements for $2,000,000.00 as to Defendant, Delcon Builders, Inc., and $1,700,000.00 as to Defendant, Edgewood Properties, Inc. Judge Douglas Hurt was the trial judge and assisted the parties in settlement.
