The plaintiff in the case filed a motion for a preliminary injunction, seeking to prevent Society Real Estate from using its own trademark. However, the court ruled in favor of our client, finding that the plaintiff did not meet the necessary burden of proof to justify the injunction.
The motion for a preliminary injunction was part of a broader lawsuit aimed at forcing our client to stop using its own trademark. Gearhart Law successfully argued that the plaintiff’s claims did not meet the legal standard for an injunction in Federal Court. While the case is still ongoing, this is a critical early victory for our client.
