Construction Worker Suffers Injury After Gasket Fails, Hitting Him in the Head
Pennsauken, NJ (Law Firm Newswire) November 24, 2022 – A construction worker was injured on a college campus while conducting a pressure test on a chiller line. The gasket failed and hit the worker. He was taken to the hospital. The Occupational Safety and Health Administration (OSHA) temporarily shut down construction to assess and investigate the accident. Although the gasket blew off during the pipe testing, no explosion occurred on the site.
When an employee is injured in a work-related accident he or she may seek compensation exclusively under the state’s worker’s compensation laws. Under New Jersey law, worker’s compensation is the exclusive remedy for work-related accidents. The injured employee must give notice to his or her employer of the injury. The employer must give notice to its worker’s compensation insurance carrier for approval or denial of the worker’s compensation claim. Upon approval of the claim, the employer’s worker’s compensation insurance covers the insured’s employees medical expenses and wage benefits.
A doctor determines the level of disability, if any, the injured employee has from his or her injury. Based on the type of disability, the wage compensation is distributed as a weekly payment that is a percentage of the employee’s pre-accident wage.
